Collection, Processing and Use of Personal Data

The legal bases of the collection, storage and processing of personal data can be found in particular in the General Data Protection Regulation (GDPR), in the German Telemedia Act (TMG) and in the Federal Data Protection Act (BDSG).

Personal data is information relating to an identified or identifiable natural person (Art. 4 no. 1 GDPR). This includes in particular names, address data, telephone numbers or e-mail addresses. However, information on preferences, memberships or e.g. previously visited websites may also constitute personal data.


Contact

If you contact us (e.g. via e-mail or our contact form), the data transmitted by you will be stored for the purpose of processing your enquiry as well as for possible processing of subsequent questions. Legal basis for the processing is the necessity to perform pre-contractual measures according to Art. 6 para. 1 b) GDPR. We will delete the data accruing in this connection after storage is no longer necessary or we restrict the processing if there are statutory retention obligations.

 

Your Rights

You have the following rights vis-à-vis us with regard to the personal data that concerns you:

  • right to rectification or erasure,
  • right to restriction of processing,
  • right of objection against processing,
  • right to data portability

To protect the security of your data during transmission, we use state-of-the-art encryption techniques (such as SSL) over HTTPS.


Disclosure to Third Parties

We disclose your personal data to third parties insofar as this is required to fulfil contracts or to process payments. Legal basis for the disclosure is the necessity to fulfil a contract according to Art. 6 para. 1 b) GDPR. A disclosure of personal data to third parties for marketing or advertising purposes will not be made without your express consent.


Newsletter

Our newsletter regularly informs you about us and the latest news in the area of PV storage systems.

If you subscribe to our newsletter, we need a valid e-mail address. After entering your e-mail address and confirming the consent wording, you will receive an automated e-mail in which you once again confirm your consent by clicking a link (double opt-in). As proof of your consent, we store your e-mail address, the consent wording, the confirmation e-mail as well as the respective IP addresses, time and date of the registration and confirmation.

Legal basis for the processing is your consent according to Art. 6 para. 1 a) GDPR.

Our newsletters are sent through the newsletter service provider "CleverReach" - by CleverReach® GmbH & Co. KG, Mühlenstraße 43, 26180 Rastede, Germany. CleverReach stores the e-mail addresses of our newsletter subscribers as well as other data described in the following, if any, on servers. The data is used by CleverReach for sending out the newsletter as well as for statistical analysis on our behalf as well as for optimisation of their own services.
Furthermore, we concluded a so-called Data Processing Agreement with CleverReach according to which CleverReach commits itself to protect the data of our newsletter subscribers, process it according to its data protection regulations on our behalf and to not pass it on to third parties. Our newsletters contain a so-called “web beacon”. This is a small file which is retrieved from the CleverReach servers when our newsletter is opened. On this occasion both technical information (e.g. about your browser and the time of your retrieval) as well as your IP address are collected and stored. This data is used by CleverReach for the statistical analysis as well as the improvement of its own services. Additionally, CleverReach can analyse the reading habits of the newsletter subscribers, in particular if and when our newsletters are being read and which links are being clicked. This analysis also serves the purpose of tailoring the newsletter offer as exactly as possible to the interests of the subscribers. Legal basis for the processing is Art. 6 para. 1 f) GDPR.

Your consent to the storage of such data as well as the use of your e-mail address for sending the newsletter can be revoked at any time. The revocation can be made via a link in the newsletters or via notification to us by e-mail. At the same time, this cancels your consent to receiving the newsletter through CleverReach and the statistical analysis of the data by CleverReach. A separate revocation of the consent to receiving the newsletter and the statistical analysis is not possible.

 

Server Log Files

Each time when our website is opened by a user, our hosting provider, Strato AG, Pascalstraße 10, 10587 Berlin, Germany, will store information in a log file. These log files contain information about retrieved data, status codes, time stamps and system information. The data is non-personal, it allows no conclusions to the specific person.

Apart from that, log files also store IP addresses. We cannot readily attribute these to a certain person.

If you would like to view our website, we collect the aforementioned data which is technically required for us in order to show you our website and to guarantee stability and safety. Legal basis for the processing is the necessity to safeguard our justified interests according to Art. 6 para. 1 f) GDPR.

 

Web Analysis with Google (Universal) Analytics

Our website uses Google (Universal) Analytics, a web analysis service of Google Inc. (www.google.de). Google (Universal) Analytics uses methods which enable an analysis of how you use the website, such as so-called “cookies”, text files that are stored on your computer. The information generated about your use of this website will as a rule be transferred to a server of Google in the USA and stored there. By activating the IP anonymisation on this website, the IP address will be shortened prior to the transmission within the Member States of the European Union or within other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a server of Google in the USA and shortened there. The anonymised IP address transmitted by your browser within the framework of Google Analytics will not be combined by Google with other data.

We use Google Analytics in order to analyse and be able to regularly improve the use of our website. Through the statistics gained we can improve our offer and make it more interesting for you as the user. Legal basis for the processing is the necessity to safeguard our justified interests according to Art. 6 para. 1 f) GDPR, namely our interest in statistical analysis of the user behaviour of our website users as well as, if applicable, their consent according to Art. 6 para. 1 a) GDPR in connection with recital 32 sentence 2 (selection of technical settings).

 

Integration of Google Maps

On this website we are using the offer of Google Maps. This means that we can show you interactive maps directly on the website and enable you to comfortably use the map function. Legal basis is Art. 6 para. 1 f) GDPR.

When you visit the website, Google receives the information that you opened the corresponding page of our website. Moreover, additional data, such as your IP address, will be transmitted to Google. This is made independently of whether Google provides a user account where you are logged in or whether you do not have a user account. If you are logged in with Google, your data will be directly attributed to your account. If you do not wish to have your data attributed to your Google profile, you have to log out prior to activating the button. Google stores your data as user profiles and uses it for purposes of advertising, market research and/or needs-based design of its website. Google Tag Manager

This website uses Google Tag Manager. Google Tag Manager is a solution operated by Google LLC. 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”) that allows marketed website tags to be managed using an interface. The Tag Manager tool itself (which implements the tags) is a cookie-less domain and does not register personal data. The tool causes other tags to be activated which may, for their part, register data under certain circumstances. Google Tag Manager does not access this information. If recording has been deactivated on domain or cookie level, this setting will remain in place for all tracking tags implemented with Google Tag Manager.



Facebook Pixel

Our website measures conversions using visitor action pixels from Facebook, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). These allow the behavior of site visitors to be tracked after they click on a Facebook ad to reach the provider's website. This allows an analysis of the effectiveness of Facebook advertisements for statistical and market research purposes and their future optimization. The data collected is anonymous to us as operators of this website and we cannot use it to draw any conclusions about our users' identities. Google Ads (formerly Google Adwords)

We use the services of Google Ads to draw attention to our attractive offers with the help of advertising materials (so-called Google Ads) on external websites. We can determine in relation to the data of the advertising campaigns how successful the individual advertising measures are. We are interested in showing you advertisements that are of interest to you, to make our website more interesting for you and to achieve a fair calculation of advertising costs.

The advertising materials are delivered by Google via so-called “Ad Servers”. For this purpose, we use ad server cookies, through which certain parameters for measuring success, such as the insertion of ads or clicks by users, can be measured. If you access our website via a Google ad, Google Ads stores a cookie on your device. These cookies usually expire after 30 days and are not intended to identify you personally. For this cookie, the unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions) and opt-out information (mark that the user no longer wishes to be addressed) are usually stored as analysis values.

These cookies enable Google to recognize your Internet browser. If a user visits certain pages of an Ads customer's website and the cookie stored on their device has not expired, Google and the customer can recognize that the user has clicked on the ad and has been redirected to this page. Each Ads customer is assigned a different cookie. Cookies cannot therefore be traced via the websites of Ads customers. We do not collect and process any personal data in the aforementioned advertising measures. We only receive statistical evaluations from Google. On the basis of these evaluations we can recognize which of the used advertising measures are particularly effective. We do not receive any further data from the use of advertising material; in particular, we cannot identify users on the basis of this information.

Due to the marketing tools used, your browser automatically starts a direct connection to the Google server. We have no influence on the extent and the further use of the data which are raised by the use of this tool by Google and inform you therefore according to our knowledge: By the integration of Ads conversion Google receives the information that you called the appropriate part of our Internet appearance or clicked an announcement of us. If you are registered with a Google service, Google may associate your visit with your account. Even if you are not registered with Google or have not logged in, it is possible that the providers may obtain and store your IP address.

 

Cookies

Like many other websites, we also use so-called "cookies". Cookies are small text files that are transferred from a website server to your hard drive. This automatically gives us certain data, such as IP address, browser used, operating system and your connection to the Internet.

Cookies can not be used to launch programs or to transfer viruses to a computer. Based on the information contained in cookies, we can facilitate navigation and enable the correct display of our websites.

In no case will the data collected by us be passed on to third parties or a link with personal data will be established without your consent.

Google and its subsidiary YouTube guarantee that they will follow the EU's data protection regulations when processing data in the United States.

We use YouTube in its advanced privacy mode to show you videos. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in improving the quality of our website. According to YouTube, the advanced privacy mode means that the data specified below will only be transmitted to the YouTube server if you actually start a video.

Without this mode, a connection to the YouTube server in the USA will be established as soon as you access any of our webpages on which a YouTube video is embedded.

This connection is required in order to be able to display the respective video on our website within your browser. YouTube will record and process at a minimum your IP address, the date and time the video was displayed, as well as the website you visited. In addition, a connection to the DoubleClick advertising network of Google is established.

Use and application of Vimeo

Our website uses plugins from the video portal Vimeo. The provider is Vimeo Inc, 555 West 18th Street, New York, New York 10011, USA.
